TERMS OF SERVICE
By ordering a commission from me, you agree that you have read and understood the Terms of Service written below, and that you are 18 years or older.
I reserve the right to change and update the Terms of Service as well as pricing at any time without notice.

1. QUOTES
a. I am happy to give quotes for commissions at any time, regardless of whether I am currently open or closed for new inquiries. Once given, it stands for all details stated, based on complexity. It can change if details are added or taken away.
b. Quotes are only valid as long as prices remain the same; if they change, and they may do so without notice, old quotes are no longer valid.

2. CONTACT
a. I accept inquiries via email (dynamo.deepblue.art@gmail.com) and via Google form whenever I have openings. Please keep messages business-related and not for idle chitchat.

If the commission is a surprise gift, I may ask for proof that you and the recipient know each other or that you have permission to use their character, to avoid mishaps or inserting their character into situations they may not be comfortable with. Please make sure that all details for the recipient's character are correct, as any changes to the final piece based on information I was not given may incur fees.
c. If the commission includes multiple characters belonging to different people, only one person is allowed to communicate with me. It is that person's responsibility to ensure that all parties involved receive updates and to inform me of any requests for changes to the piece. Requests for changes that I was not informed of will incur fees if they are desired after approval at any stage.

3. PAYMENT METHODS
a. Currency is in USD only.
b. Payments are made via invoices sent to clients using Square. This is the primary method I use unless the client is in a country outside of the ones supported by this service, in which case the invoice will be sent via Paypal. Only a valid email address you have access to is needed to receive and pay an invoice via Square; a Square account is not necessary to pay these invoices.
Why Square? PayPal is a service used a wider range of countries, but charges merchants higher fees to accept payments, which hurts small businesses, while Square charges noticeably less. Fewer fees means I make more money, which allows me to continue doing more of what I love more easily over time.
Countries supported by Square include: United States (except Puerto Rico, Guam, the U.S. Virgin Islands, American Samoa, and Northern Mariana Islands), Canada, Australia, Japan, the United Kingdom, Republic of Ireland, France, Spain.
PayPal will be used to send invoices to clients who live outside of the above-mentioned countries, or in any of the US territories listed above. If for some reason a client is not able to pay an invoice via Square due to technical difficulties, PayPal will be the alternative option for payment as well.
c. Money sent to me will be refunded unless paid via invoice. No cash payments or payments via mail or money orders.
d. I do not accept cryptocurrency of any kind as payment for commissions. Anyone who purchases from me using cryptocurrency will be prohibited from working with me in the future.
4. PENDING PAYMENTS AND PAYMENT PLANS
a. If the invoice has only been partially paid, the client may be refunded for any money they have already sent if a payment deadline is missed and cannot be met, or if you decide to cancel your commission.
b. Slots cannot be held for any reason if payment, whether or partial or full, cannot be made immediately upon inquiry (ex: waiting for pay days or the client needs to contact other parties for confirmation). At this time I currently do not use waitlists for openings or slots. If the client does not send their payment in a reasonable time frame, their slot may be forfeited or given to another client at my own discretion.
c. If the client fails to pay an invoice, and requests a new commission with the same idea at a later time, they may receive a new quote with a different price if prices change during that time. This is non-negotiable.
d. The client will be given the option to make payments on your commission using Afterpay (which requires an account) on Square invoices. This enables the client to make payments in 4 installments over a period of several weeks, regardless of commission type. I receive the full amount immediately, which allows me to begin work on your piece sooner.

d. Failure on behalf of the client to meet their own financial obligations is not a legitimate cause for a refund (Ex: Client pays for a commission knowing they have an upcoming bill and asks for a refund to accommodate it once I have already started work).

6. DEADLINES AND TURNAROUND TIMES
a. Delivery of final commissioned drawing is usually within 1-2 months from the date your piece is fully paid for. Colored Sketches generally have same-day turnaround times of 3 hours or less (assuming the piece contains a single character). Acrylic charms commissions have a longer turnaround of at least 2 months, including completed artwork and shipping and delivery of the physical product.
b. I may do smaller commissions first, and so on, but I keep the order in which I received all pieces in my queue in mind.
c. I can meet hard deadlines within reasonable time frames if requested. Rush orders, including next-day orders (if possible), will be charged a fee relative to the time frame and type of commission requested to place them further up in the queue if there are other orders to be completed at the time.

b. Please be considerate when asking for updates on commissions. I cannot show progress for a piece I have not started, and I do not always complete commissions in a single sitting. Please watch the queue page for awhile before asking for updates. If I have progress to show you, I am more than happy to share it with you if you ask.

8. EDITS AND WORKS IN PROGRESS
a. I always provide sketch WIPs to clients, then work through the rest of the piece to the end. WIPs for lines and color must be specifically requested by you. I will provide sketch and color WIPs for reference sheet commissions. Colored Sketches do not receive WIPs at all due to their much shorter turnaround time compared to other commission types. You are not permitted to edit a WIP sketch for your own use or to have another artist finish the sketch, via commission or otherwise. You may post a watermarked version of a WIP, provided by myself, anywhere online.
b. Clients are allowed up to 3 free edits for standard commissions and up to 5 for reference sheets. Any revision after that will be charged a $20 fee per revision. If the client does not agree to pay for their requested changes, I will proceed and complete the image as originally instructed, without any of the requested changes. Small changes may or may not be charged a fee at my own discretion.
c. If I accidentally leave out important details that were mentioned at the beginning, these will be fixed free of charge.
d. If client does not approve the initial sketch and requests a completely new one, they will be charged 25% percent of the price of the commission for the extra time it takes to draw a new sketch.
e. No edits will be made to a finished commission considered unsatisfactory by the client, and I will not accept any request to redraw it.
f. I will not make major changes to a finished commission if a considerably long time has passed since its completion and approval (such as removing a character from a couples piece or updating a piece to include any details that may have changed on a character's design; mostly changes that involve drastic changes to the line art or composition). Any smaller changes are subject to my own discretion.
g. Be aware that artistic liberty will be taken with your piece if I am not given specific details or ideas. Being specific to a reasonable degree allows me to deliver a quality piece that is most to the client's liking and reduces workload and time to completion (so that excessive revisions do not slow down workflow).

a. You are commissioning me for my style and my style only. Please do not ask me to replicate the style of another artist. Even when it comes to drawing characters from TV, games, etc. they may be drawn similar to but not in the exact same way as they appear in that series, as I prefer to put my own unique spin on things.
b. Please trust my judgment. I have the right to decline edits that I believe do not fall within the parameters of my style or that I believe would reduce the quality of the piece.
c. I will require some artistic liberty when working on your piece. For example, certain details may be simplified or drawn slightly differently than normal. Colors may also be brightened or changed slightly for the sake of making the piece look more cohesive or vibrant. This does not mean I will not make your piece to your specifications; I simply need to be able to create a quality piece with my own flair to make it unique and memorable.
a. You are commissioning me for my style and my style only. Please do not ask me to replicate the style of another artist. I retain full rights to my artwork, including (but not limited to) the ability to do the following with your commissioned image: to promote myself online, to reuse your commission in personal projects, to include it in portfolios and to make and sell prints or other merchandise featuring the image.
b. I have the right to choose which commissions I post online to any website or social media I frequent. I am not obligated to upload your commission to any site or remove it from any site if I have uploaded it. Clients may choose to remain anonymous, but I reserve the right to showcase any commission to any person at my own discretion, and as such, the client may not request to keep their commissions private.
c. I have the right to refuse a commission for any reason, including but not limited to the following: personal reasons such as comfort level of subject matter, harassment from the client or otherwise hostile behavior, haggling or going against the Terms of Service.
d. I understand if there may be a language barrier, but please try to be as clear, coherent and concise as possible about the details of your commission when ordering or requesting a quote. I have the right to refuse a commission if effective communication is not possible.

11. CLIENT RIGHTS
a. You reserve the right to the original characters in the art that you have commissioned from me. You are prohibited from claiming artwork as being made by you.
b. Claiming the rights to your commissioned drawing without prior discussion, reselling it or designs of characters within your piece that I have created that are not explicitly stated to be yours for real, website-exclusive currency or cryptocurrency, making and selling any physical or digital content of the image, editing the image, and erasing my watermark or signature from the image is prohibited and is considered art theft.
c. Clients are not permitted, under any circumstances, to use any part of their commissioned artwork or any non-commission artwork of my own for non-fungible tokens (NFTs), or for any advertising or profits associated with non-fungible tokens or cryptocurrency. The client is also not permitted to use any part of their commissioned artwork, or any non-commission artwork of my own in AI art generators to create AI art. These actions are treated as theft and the client will be prohibited from working with me in the future.
c. You may print out and reference commissions I have done for you, crop them for use as icons, profile photos, etc. and use them as wallpapers. You are allowed to post your image online with credit given to me by linking back to any of my sites, or by listing my name or username as the artist, and you do not need to ask permission to do so. Show it off to everyone!
